About the Demand Letter

My lawyer explained that before I file with small claims court against Mia Bella Couture that I should send a demand letter. This letter with the certified delivery offered by the post office which is probably the least expensive certified service. Even though FedEx and UPS both prove delivery, but aren’t certified mail services. Not only are they less expensive but if you are dealing with one government agency (courthouse), it makes sense to use the other government agency to deliver the mail.

I sent the demand letter before I filed with small claims court was easy since my claim is straightforward against Mia Bella Couture. Whatever the reason they claim they charged me for couldn’t have been authenticated unless they have my authorization to charge my credit card. Best practices for accepting credit cards is described by Square, Sage, and Visa on page 20.

I have been in contact with D.  several times in the past couple months without being any closer to resolution or an understanding of your company’s position is with this dispute. At this point the only solution here is returning all money my account was changed for no reason and nothing to show for it. I have never met either of you, been to either of your stores or handed you any form of payment. I am surprised to know you have justified keeping my money so long.

If I do not have a valid bank check for the $2000 sent to the above address I will be filing with Fresno Court where I will be asking for any amount over $2000 that a court will award based on all the time I have put into retrieving monies for this fraudulent charge.
